Rentproperty.co.za is a custom designed site where landlords and estate agents not only list property for rent, but also check to see what is going on in the market - be it residential or commercial (commercial in design phase at the moment). Most estate agent sites that list property for rent, lack search and reporting functionality and performance is slow - often with outdated or non-existent content. To add to this problem is the fact that the available rentals are scattered across a multitude of sites in an incoherent way. Traditional estate agencies typically neglect rentals because the revenue stream for rentals offers far less incentive than sales. Rentproperty.co.za provide search/reporting functionality for all the stakeholders in the property renting business i.e. landlord, prospective tenant, estate agent or commercial broker. In addition - online dynamic real-time statistics is shown to assist decision-making of these stakeholders. For instance it is possible in an instant to see whether the asking rent of 4 bedroom houses within security estates has increased or dropped over the last 3 months in a particular suburb, across cities or across the whole of South Africa.
TERMS OF USE
PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. BY USING THE RENTPROPERTY.CO.ZA WEBSITE ("THE SITE"), YOU ("THE USER") ARE INDICATING YOUR ACCEPTANCE TO BE BOUND BY THE TERMS OF THESE TERMS AND CONDITIONS. These terms and conditions of use may be changed in the future without further notice. The User's continued use of the Site after any such changes constitutes the User's acceptance of the new terms. Further, these terms and conditions apply exclusively to the User's access to, and use of, the Site and do not alter in any way the terms or conditions of any other agreement you may have with RENTPROPERTY.CO.ZA for products, services or otherwise.
  • 1.General provisions
    • 1.1.The headings of the clauses in the conditions is provided for convenience and ease of reference only and will not be used to interpret, modify or amplify the terms of the conditions.
    • 1.2.No failure or delay by RENTPROPERTY.CO.ZA to exercise any of its rights will be construed as a waiver of any such right, whether this is done expressly or implied, nor will it affect the validity of any part these terms and conditions or prejudice our right to take subsequent action against the user.
    • 1.3."Us" and "RENTPROPERTY.CO.ZA" are used interchangeable and refers to Netcommerce Consulting Ltd (reg no 04466546), a company incorporated in the United Kingdom, and includes any agents and / or assigns of Netcommerce Consulting Ltd.
    • 1.4."You" and "User" are used interchangeable and refer to all individuals and/or entities accessing the Site for any reason.
  • 2.Privacy Statement
    • 2.1.RENTPROPERTY.CO.ZA recognises the importance of protecting the User's personal information. Therefore, we have put together and follow a policy that respects and addresses the User's needs.
    • 2.2.Information collection
      • 2.2.1.RENTPROPERTY.CO.ZA is the sole owner of the information collected on the Site. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. RENTPROPERTY.CO.ZA collects information from the User at several different points on the Site.
      • 2.2.2.Consent to collect information can be express (for example signing an agreement) or implied (e.g. if the User is given an opportunity to opt-out of a specific form of information sharing, but chooses not to do so, this implies that the User chooses to share this information with us).
    • 2.3.What information does RENTPROPERTY.CO.ZA collect? At different times, RENTPROPERTY.CO.ZA may collect three types of information about the User.

This information is aggregated to measure the number of visits, average time spent at the Site, pages viewed, etc. RENTPROPERTY.CO.ZA uses this information to determine use of the Site, and to improve content thereon. This information may include but is not limited to the User's name, phone number, e-mail address and property information. The User may always choose not to provide us with this information; however, this may limit our ability to provide the User with a specific service or offer the User personalized content.
    • 2.4.What other uses does RENTPROPERTY.CO.ZA have with the data it collects?
      • 2.4.1.Whenever RENTPROPERTY.CO.ZA collects data, the data is intended to tailor or improve the experience of visitors to the Site. From the data collected we can customize content and advertising based on the User's preferences. We analyze what our users prefer in order to improve RENTPROPERTY.CO.ZA. Some broad statistical customer data is provided to our advertisers (e.g., property type), but specific personal information is not shared with our advertisers, except as otherwise stated.
      • 2.4.2.On occasion we will send e-mails to the User with information that we think the User will find useful, including information about new services and information of parties showing interest in the User's advertisement. We might also contact the User by e-mail to see if the User is interested in participating in market research regarding RENTPROPERTY.CO.ZA. It is our policy to send these promotional e-mails only to users who give us permission to do so. In every such e-mail, we will also have instructions on how to unsubscribe and avoid receiving any future e-mails from us. Please see our Opt Out Policy section below. RENTPROPERTY.CO.ZA also may contact the User by e-mail to respond to customer-service complaints the User have submitted, to address a problem affecting the User's use of the service or to verify the User's account information if the User submit a password request. If at any time the User feels the User have received e-mail from RENTPROPERTY.CO.ZA that the User did not request, please send the User's concerns, along with a copy of the e-mail, to INFO@RENTPROPERTY.CO.ZA.
    • 2.5.With whom does RENTPROPERTY.CO.ZA share data?
      • 2.5.1.RENTPROPERTY.CO.ZA may share the User's advertisement with third parties in order for them to place the advertisement on their website and maximise the exposure of the User's advertisement or to respond to the User's advertisement.
      • 2.5.2.RENTPROPERTY.CO.ZA will not voluntarily disclose any information about individual users, except as described in this Privacy Statement, or to comply with applicable laws or valid legal process, or to protect the rights or property of RENTPROPERTY.CO.ZA or others, to assist our e-mail vendor with resolving complaints about unsolicited e-mail, or as otherwise described in this Privacy Statement.
    • 2.6.What choices are available regarding collection, use and distribution of the information (Opt Out Policy)?
      • 2.6.1.Many of the services available on the Site provide the User with the opportunity to opt out of receiving communications from us and our partners. In addition, in our e-mail communications, RENTPROPERTY.CO.ZA will have instructions on how to unsubscribe so that the User will not receive any future e-mails from us if the User so choose.
      • 2.6.2.As previously noted, the User may always choose to not provide RENTPROPERTY.CO.ZA with any of the information we request; however, this may limit our ability to provide the User with a specific service or limit our ability to offer personalized content.
      • 2.6.3.If you have trouble to deactivate the User's membership or to modify the User's account or profile information, please e-mail INFO@RENTPROPERTY.CO.ZA.
    • 2.7.How can the User update or correct the User's information? If a the User's personally identifiable information changes (such as the User's e-mail address), or if the User's advertisement changes, or if the User no longer desires RENTPROPERTY.CO.ZA's service, RENTPROPERTY.CO.ZA will provide a way to correct, update or remove that User's personal data provided to RENTPROPERTY.CO.ZA. This can be done from the MY PROFILE page or by e-mailing RENTPROPERTY.CO.ZA at INFO@RENTPROPERTY.CO.ZA.
    • 2.8.What procedures have been designed to protect the loss, misuse or alteration of information under RENTPROPERTY.CO.ZA's control?
      • 2.8.1.RENTPROPERTY.CO.ZA takes every precaution to protect the User's information.
      • 2.8.2.RENTPROPERTY.CO.ZA also does everything in their power to protect User information offline. Access to all of our Users' information, not just the sensitive information mentioned above, is restricted in our offices. Only employees who need the information to perform a specific job are granted access to personally identifiable information. Finally, the servers that we store personally identifiable information on are kept in a secure environment.
      • 2.8.3.Online payments made through the RENTPROPERTY.CO.ZA website are made available to you through a third party in a secure environment. Their website uses secure server software (SSL) for secure commerce transactions. It encrypts all your personal information, instructions and enquiries, so it cannot be read as the information travels over the Internet.

In such a transaction, customer information may be transferred to the acquiring entity.       • 2.11.1.We send all new members a welcoming e-mail to verify password and username. If a User wishes to subscribe to our newsletter, we ask for contact information such as name and e-mail address. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see our Opt/Out section below.
      • 2.11.2.We also send the User site and service announcement updates. Members are not able to unsubscribe from service announcements, which contain important information about the service. We communicate with the User to provide requested services and in regards to issues relating to their account via e-mail.

You agree to indemnify and hold harmless RENTPROPERTY.CO.ZA from any claim, action, demand, loss or damages (including attorneys' fees) made or incurred by any third party arising out of or relating to the User's conduct, the User's violation of these terms and conditions, or the User's violation of any rights of a third party.
    • 9.2.The articles, templates, tools, services and other material provided on this site or by e-mail are for informational purposes only and are not intended to take the place of professional advice from the User's accountants, lawyers, business consultants, or other advisors. Please contact your own advisors regarding your particular situation.
    • 9.3.RENTPROPERTY.CO.ZA takes no responsibility and assumes no liability for any Content posted or uploaded by you or any third party, or for any mistakes, defamation, slander, libel, omissions, falsehoods, obscenity, pornography or profanity you may encounter. The submission of any materials to RENTPROPERTY.CO.ZA, including the posting of materials to any forum or interactive area, irrevocably waives any and all "moral rights" in such materials, including the rights of paternity and integrity.
  • 11.Subscription
    • 11.1.You may subscribing to a Service in any way including (without limitation) in writing, through the Internet or by telephone.
    • 11.2.Only after RENTPROPERTY.CO.ZA received proof of payment of the relevant Service and/or a signed Debit Order form, will the Service be activated for the User.
    • 11.3.You may cancel such subscription at any time by notifying us.
    • 11.4.We may cancel your subscription if you do not visit the Site at least once a week, your subscription expired or is not paid for. When your subscription is cancelled, you may no longer have access to content you have posted to, or which you keep on or via, the Site, and we may remove such material.
    • 11.5.We may remove content from the Site that was posted by you if we, in our sole discretion, are of the opinion that the content is out of date.
    • 11.6.Should we remove content in terms of clauses 11.4 and 11.5, then notwithstanding anything else contained in this agreement, your only right of recourse will be to provide us with legitimate reasons as to why your subscription may not be cancelled or content be removed. Should we decide to re-activate your subscription or that you my re-post the content, you must replace the content that was removed by us.
  • 12.Service Charges and Payment
    • 12.1.Serurubele Trading 23 (Pty) Ltd (reg no 2007/016374/07) is the appointed agent of Netcommerce Consulting Ltd to deal with subscriptions and payment related services.
    • 12.2.In order to subscribe to certain Services a User is required to enter into separate agreements with us on an ad hoc basis. The terms and conditions of such agreements will be conveyed to the User when the User proceeds to transact.
    • 12.3.Before a User subscribe to or use a Service the User will be informed of the amount of the Service Charges.
    • 12.4.We reserve the right at any time to:
      • 12.4.1.charge fees; and
      • 12.4.2.to vary or amend the terms and conditions which cover such fees, for access to or use of all or some parts of the Site.
    • 12.5.By subscribing to or using a Service the User:
      • 12.5.1.agree to pay the Service Charges on the due date, regardless of whether the User use the Service or not; and
      • 12.5.2.authorise RENTPROPERTY.CO.ZA to perform a credit check at any time and provide the User's Personal Information to a credit bureau for this purpose.
    • 12.6.RENTPROPERTY.CO.ZA may implement a new, or change an existing debit order for the Service Charges due by the User against the bank account the User provided to RENTPROPERTY.CO.ZA.
    • 12.7.All Service Charges are payable in advance and non-refundable.
    • 12.8.If the User fail to make any payment for any reason when due, RENTPROPERTY.CO.ZA may:
      • 12.8.1.suspend the User's subscription to or use of a Service;
      • 12.8.2.remove content listed y the User;
      • 12.8.3.claim any amounts due to RENTPROPERTY.CO.ZA; and/or
      • 12.8.4.charge you interest at a rate of 15.5% on all outstanding monies, calculated from due date to date of actual payment, both days inclusive.
    • 12.9.Unless stated otherwise, all Service Charges exclude value-added tax.
    • 12.12.The User may not:
      • 12.12.1.withhold payment of any amount due to RENTPROPERTY.CO.ZA by reason of any alleged breach of the Terms by RENTPROPERTY.CO.ZA, or for any other reason; or
      • 12.12.2.apply set off in respect of any amount due to RENTPROPERTY.CO.ZA.
    • 12.11.All amounts due and payable by the User at any time will be determined and proved by a certificate signed by one of RENTPROPERTY.CO.ZA's directors or general managers, whose appointment, qualification and authority RENTPROPERTY.CO.ZA need not prove.
    • 12.12.Such a certificate will be deemed to be a liquid document for the purpose of obtaining summary judgment, provisional sentence or any other judgment against the User.
    • 12.13.RENTPROPERTY.CO.ZA may charge the User an additional re-connection Service Charge if the User request RENTPROPERTY.CO.ZA to restore any Service, which was terminated, either at RENTPROPERTY.CO.ZA's instance or the User's.
    • 12.14.The Service Charges may change from time to time as provided herein.
    • 12.15.RENTPROPERTY.CO.ZA may from time to time provide the User with accounts, statements or invoices for amounts due to RENTPROPERTY.CO.ZA.
  • 13.Disclaimer of Warranties
    • 13.1.The User understand and agree that this Site and the information, services, products and materials available through it are provided on an "as is" and "as available" basis. The User expressly agree that use of this site, including all content, data distributed by, downloaded or accessed from or through this site, is at the User's sole risk.
    • 13.2.RENTPROPERTY.CO.ZA and their agents does not make any warranty that this site or its content will meet the User's requirements, or that the site or content will be uninterrupted, timely, secure or error-free, or that defects and inaccuracies, if any, will be corrected.
    • 13.3.RENTPROPERTY.CO.ZA does not represent or warrant that materials in this site or information provided by RENTPROPERTY.CO.ZA via e-mail or other means are accurate, complete, reliable, current or error-free. Nor does RENTPROPERTY.CO.ZA make any warranty as to the results that may be obtained from use of RENTPROPERTY.CO.ZA or its content or as to the accuracy, completeness or reliability of any information obtained through use of the site.
    • 13.4.The User acknowledge that RENTPROPERTY.CO.ZA does not control in any respect any information, products or services offered by third parties on or through this site. Except as otherwise agreed in writing, RENTPROPERTY.CO.ZA and its affiliates assume no responsibility for and make no warranty or representation as to the accuracy, currency, completeness, reliability or usefulness of content or products distributed or made available by third parties through this site.
  • 14.Limitation on Liability
    • 14.1.The User subscribes to and uses the Site and any Service at the User's own risk.
    • 14.2.Under no circumstances, including without limitation negligence, shall RENTPROPERTY.CO.ZA or its parents, subsidiaries, affiliates, officers, directors, employees, agents, suppliers be liable for any indirect, incidental, special or consequential damages arising from or in connection with the use or inability to use RENTPROPERTY.CO.ZA or any content provided by or through this site, or resulting from unauthorized access to or alteration of the user's transmissions or data, or other information that is sent or received, including but not limited to damages for lost profits, use, data or other intangibles, even if RENTPROPERTY.CO.ZA has been advised of the possibility of such damages.
    • 14.3.RENTPROPERTY.CO.ZA shall not be liable to the User in terms of any agreement in delict, contract, warranty or otherwise for an amount which is more than the revenue received from the User, for any consequential or direct damage suffered by the User, which arises out of or is pursuant to any gross negligent or wilful act or omission by RENTPROPERTY.CO.ZA or its employees or consultants. The amount of revenue received by RENTPROPERTY.CO.ZA, for the purpose of this clause, shall be the revenue received in terms of the Agreement, from the User up to the date on which the cause of action arose.
    • 14.4.Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, in such jurisdictions, liability is limited to the fullest extent permitted by law.
    • 14.5.The articles, templates, tools, services and other material provided on this Site or by e-mail are for informational purposes only and are not intended to take the place of professional advice from the User's accountants, lawyers, business consultants, or other advisors. The User must contact the User's own advisors regarding the User's particular situation.
  • 15.Electronic Communications
    • 15.1.By using this Web Site or communicating with RENTPROPERTY.CO.ZA by electronic means, the User consents and acknowledges that any and all agreements, notices, disclosures, or any other communication satisfies any legal requirement, including but not limited to the requirement that such communications should be "in writing".
    • 15.2.Data messages addressed by the User to RENTPROPERTY.CO.ZA will only be deemed to have been received by RENTPROPERTY.CO.ZA if and when RENTPROPERTY.CO.ZA responds thereto.
    • 15.3.Data messages addressed to you by RENTPROPERTY.CO.ZA, however, will be deemed to have been received by the User as detailed in section 23 (b) of the Electronic Communications and Transactions Act (25 of 2002) ("ECT").
    • 15.4.Data messages addressed by the User to RENTPROPERTY.CO.ZA will be deemed to have been created and sent by you within the geographical boundaries of South Africa.
    • 15.5.Electronic signatures, encryption and/or authentication are not required for valid electronic communications between RENTPROPERTY.CO.ZA and the User.
    • 15.6.The User warrant that the data messages sent to RENTPROPERTY.CO.ZA from a computer, IP address or mobile device normally used or owned by the User, were sent and or authorised by the User personally.
    • 15.7.By subscribing to or using a Service, the User agree that RENTPROPERTY.CO.ZA may intercept and monitor any communication that the User make or receive to the extent allowed by law or for the purpose of conducting our business and securing RENTPROPERTY.CO.ZA's systems.
  • 16.E-mail Notice
    • 16.1.The information in all e-mail messages (document and attachments) sent by an employee / electronic agent / agent / a director of RENTPROPERTY.CO.ZA ("the Company") is confidential and may be legally privileged. The information transmitted is intended only for the person(s) or entity to which it is addressed. If you are in the possession of an e-mail from RENTPROPERTY.CO.ZA which is not addressed to you or for your attention, please:
      • 16.1.1.notify the sender immediately;
      • 16.1.2.delete the e-mail (document and attachments);
      • 16.1.3.do not disclose the contents of the e-mail (document and attachments) to any other person, nor make any copies thereof.

    • 16.3.No employee is authorised to conclude a binding agreement on behalf of RENTPROPERTY.CO.ZA by e-mail without the express written confirmation of a director of RENTPROPERTY.CO.ZA. Nothing contained in e-mails sent by or on behalf of RENTPROPERTY.CO.ZA shall be construed as a legally binding agreement or an offer to contract.
  • 17.Applicable Law
    • 17.1.The terms and conditions are governed by and construed under the laws of the Republic of South Africa and all disputes, actions and other matters relating thereto will be determined in accordance with such law
    • 17.2.The User agrees that this agreement will be concluded between RENTPROPERTY.CO.ZA and the User in Cape Town, South Africa at the time when the User gain access to the Site for the first time.
    • 17.3.The User hereby consents to the jurisdiction of the Magistrate's Court despite the fact that the amount of any claim against the User exceeds the jurisdiction thereof. The User further agree that should any dispute be referred to the High Court, the User consent to the jurisdiction of the Cape of Good Hope Provincial Division of the High Court of South Africa.
    • 17.4.The terms and conditions applicable to any product, service or information will be those determined at the time of provision of the product, service or Information.
  • 18.Termination Notwithstanding any of these terms and conditions, RENTPROPERTY.CO.ZA reserves the right, without notice and in its sole discretion, to terminate the User's license / subscription to use the Site, and to block or prevent future access to and use of the Site or Service.
  • 19.Severability If any provision of these terms and conditions is held to be invalid, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
  • 20.User's Liability to RENTPROPERTY.CO.ZA In the event that RENTPROPERTY.CO.ZA takes action against you for breach of these terms of use, you agree to reimburse RENTPROPERTY.CO.ZA for all legal costs, including tracing fees and collection commission, on a scale as between attorney and own client.
